Personal Injury Attorney for Alamance County, NC
Alamance County is where I grew up, where I went to school, where I've practiced law for 28 years, and where I still live.
I know this county the way someone knows their own neighborhood. I know which roads generate the most serious crashes, which hospital handles the most Alamance County victims, and exactly what it takes to file a personal injury case at the Historical Courthouse on 1 Court Square in Graham. I've been walking to that building since 1998.
This page covers personal injury law as it applies across all of Alamance County -- Burlington, Graham, Mebane, Elon, Haw River, Swepsonville, and every unincorporated area in between. All civil personal injury cases in this county file at the same courthouse, two blocks from my office. Use this page as your starting point. The city pages below go deeper on specific crash data, police report procedures, hospital distances, and local incidents for each community.
If you've been in a crash anywhere in Alamance County, call me before you talk to anyone's insurance company.

The I-40/I-85 Corridor: Alamance County's Primary Crash Zone
SHORT ANSWER: The I-40/I-85 Sam Hunt Freeway runs east-west through all of Alamance County and is the primary source of serious crash cases in the county. Commercial truck traffic is constant. Documented pileups include 53 vehicles near mile marker 259 in February 2025 and 45-50 vehicles near mile marker 158 in August 2019. Multi-vehicle corridor crashes involving trucks require early evidence preservation -- black box data can be deleted in 30 days.
The interstate cuts across all of Alamance County carrying both local commuter traffic and commercial freight between Greensboro and the Research Triangle. Alamance is a bedroom community -- many residents commute east to RTP or west to Greensboro daily. That volume, combined with commercial truck traffic, creates sustained crash risk at high speeds along every exit from Exit 140 in the west to Exit 154 in the east.
Beyond the interstate, NC-87 south of Graham toward Chatham County is a two-lane rural highway with documented center-line crossing fatalities. US-70 through Burlington and Haw River produces serious intersection crashes. The Exit 152 area near Mebane has active road construction for the Buc-ee's and Target development, adding construction-zone crash exposure through at least 2026.
North Carolina Personal Injury Law in Alamance County
SHORT ANSWER: Three years to file a personal injury claim under N.C. Gen. Stat. § 1-52(5).Two years for wrongful death under § 1-53(4). Pure contributory negligence -- 1% fault may bar all recovery. As of July 1, 2025, NC minimum auto insurance is 50/100/50 and UIM stacks on top of liability under N.C. Gen. Stat. § 20-279.21. These rules apply across all of Alamance County.
The Statute of Limitations
Three years from the accident date under N.C. Gen. Stat. § 1-52(5). Wrongful death is two years from the date of death under N.C. Gen. Stat. § 1-53(4) and § 28A-18-2 -- not the accident date. Miss either deadline and the court dismisses permanently. The discovery rule under § 1-52(16) can delay the clock for injuries not immediately apparent, with a 10-year hard cap.
Pure Contributory Negligence
North Carolina is one of roughly four states still using pure contributory negligence. If a jury finds you were even 1% responsible for your crash, you may recover nothing. Insurance adjusters raise this at every stage of settlement to pressure claimants into lowball offers. Don't give recorded statements without an attorney.
The July 2025 Insurance Law Change
Effective July 1, 2025, North Carolina raised its minimum auto liability coverage from 30/60/25 to 50/100/50 under Senate Bill 452 (Session Law 2023-133), codified at N.C. Gen. Stat. § 20-279.21. UIM coverage now stacks on top of the at-fault driver's liability policy instead of offsetting it. Applies to policies issued or renewed on or after July 1, 2025.
| Rule | What It Means | Statute | Practical Impact |
|---|---|---|---|
| 3-year PI deadline | File within 3 years of accident date | § 1-52(5) | Miss it: permanent dismissal |
| 2-year wrongful death | File within 2 years of date of death | § 1-53(4) / § 28A-18-2 | Starts from death date, not crash date |
| Pure contributory negligence | 1% fault = $0 recovery | NC common law | Adjusters use it as settlement pressure |
| Insurance minimums (post-7/1/25) | 50/100/50 required | § 20-279.21 | UIM now stacks; prior was 30/60/25 |
| Punitive damages — DWI | No cap on punitive | § 1D-26 | Standard 3x/$250K cap does not apply |
| Helmet non-use | Not negligence per se | § 20-140.4(b) | Adjusters still argue worsened injuries |

One detail that catches people off guard: the Graham Police Department is at 216 South Maple Street. Not 201 South Main Street -- that is the Fire Department. A second detail: the eastern portion of Mebane near Exit 157 at Buckhorn Road is in Orange County. Cases from that area file in Hillsborough, not Graham. I handle both.
